1. About these Terms
These Terms govern the purchase, download and use of the digital products ("Products") offered on Assayhouse at https://assayhouse.eu (the "Website"), and the use of the Website.
The Website and the Products are provided by:
- Ivan Zifčák ASSAYHOUSE, Self-employed person (sole trader)
- Registered office / place of business: Slnečnicová ulica 40, 949 01 Nitra, Slovak Republic
- IČO: 57948089 · Not registered for VAT
- Registered in: Trade Register (Živnostenský register), Okresný úrad Nitra, registration number 430-75716
- Email: info@assayhouse.eu · Telephone: +421 918 191 015
"We", "us" and "our" mean the business above. "You" means the person using the Website or buying a Product.
A Consumer is a natural person acting mainly outside their trade, business, craft or profession. A Business Customer is a person or entity buying mainly for business or professional purposes. Provisions marked as applying to Business Customers do not apply to Consumers.
Using the Website is governed by sections 23 to 25. When you place an order, you accept these Terms for that purchase. If you do not agree, please do not complete a purchase.
2. Merchant of Record
Payments are processed by Stripe (acting through Link as Merchant of Record under Stripe Managed Payments), which acts as Merchant of Record and reseller for the transaction.
Stripe is responsible for processing the payment; calculating, collecting and remitting VAT, GST or sales tax; issuing the receipt or tax invoice; paying out approved refunds; and handling payment fraud and chargebacks. Your Stripe receipt is your record of the transaction.
We are responsible for creating and describing the Products, holding the rights to distribute them, product-level support, resolving problems with corrupted, incomplete or incorrect files, receiving and handling withdrawals and complaints, operating the Website, and our own policies.
Stripe's buyer terms and policies also apply to payment, refunds and chargebacks. They never reduce your statutory rights. If these Terms and Stripe's terms conflict on payment processing, tax, receipts, payment fraud or chargebacks, Stripe's terms apply to the extent the law permits.
3. Who can buy
You may buy a Product if you have the legal capacity to enter into a binding agreement, give accurate checkout information, may lawfully buy and receive the Product in your country (including under sanctions and export rules), and comply with Stripe's terms. You must be at least 18, or the age of majority where you live, to buy without a parent or legal guardian. If you buy for an organisation, you confirm that you may bind it.
4. The Products
Products are digital files in PDF format, written in English. Unless the product page says otherwise: nothing is shipped; you receive the final PDF only (no editable, source, layout or project files); no consulting or personalised advice is included; and you receive the edition available on the day of purchase.
Each product page describes the Product's main characteristics: title, subject, language, edition and revision, approximate page count, contents, format, technical requirements, and printing information. Please read it before you buy.
5. Educational content only
The Products are educational. They are not medical, dermatological, legal or regulatory advice. They do not assess whether any ingredient or product is safe, effective or suitable for you, and they do not recommend products or brands. The information reflects the sources available on the edition date and may not reflect later changes. For a skin condition or health question, consult a qualified professional. Nothing in this section excludes liability that cannot lawfully be excluded.
6. Product information and availability
We take reasonable care that descriptions, previews and prices are accurate. Minor typographical, formatting, colour, screen or printer differences do not by themselves make a Product defective. We may correct obvious errors, update descriptions, withdraw or stop offering a Product, release a revised edition, change future prices, or limit availability in some countries. Such changes do not reduce your rights for a completed purchase. If a material price or description error is found before delivery, we may cancel the order and the payment will be returned through Stripe.
7. Prices, taxes and payment
All prices shown include VAT or other sales tax where it applies. The final price, currency and tax are shown at checkout before you pay. Stripe determines and collects the applicable tax based on your location. If currency conversion applies, Stripe or your bank may use its own exchange rate or charge fees that we do not control. The price that applies is the one shown and accepted at checkout.
Accepted payment methods: those shown at checkout, which depend on your country and device (as offered by Stripe at checkout).
8. How an order is made
- Choose a Product and read the product page.
- Tick the box requesting immediate access and acknowledging that you lose your right of withdrawal once the download or access begins (see section 10). The buy button becomes available once it is ticked.
- Enter your details and pay on Stripe's checkout, where you can check and correct your details before confirming.
Please check the Product, format, total price and your email address before paying. The contract is concluded when the payment is authorised, Stripe accepts the transaction and an order confirmation is issued. We may refuse or cancel an order where reasonably necessary because of payment failure, suspected fraud, an obvious pricing error, a sanctioned or unlawful transaction, misuse of the Website, unavailability of the Product, a legal requirement, or a decision of Stripe. If an accepted order is cancelled without delivery, the payment is returned through Stripe.
9. Electronic communications
You agree that transaction-related communications (order confirmation, receipt, download instructions, withdrawal and refund notices, support replies, and notices required by law) are sent by email. Please give a valid address and make sure messages from us and from Stripe are not blocked. We do not send marketing emails.
10. Immediate digital delivery and your consent
The Product is made available immediately or shortly after successful payment, by a download link, download page or email.
Because the Product is delivered immediately, before you pay you will be asked to tick an unticked box to:
- request immediate access to the Product;
- expressly agree that supply begins before the 14-day withdrawal period ends; and
- acknowledge that you lose your right of withdrawal once the download or access begins.
You receive a confirmation of this consent with your receipt. Once the download or access has begun, the right of withdrawal ends. Until then it applies in full (section 18). This does not affect your rights if the Product is not supplied or is not in conformity with the contract (sections 17, 19 and 20).
11. Delivery problems
If you do not receive the Product, check the email address used at checkout, your inbox, your spam folder, your Downloads folder, and any order link from Stripe. If it is still missing, email info@assayhouse.eu with your order number, checkout email, the Product name and a short description. After verifying the order we will resend the link, restore access, email the PDF, or use another secure method. If we cannot deliver the Product without undue delay, you are entitled to a refund.
12. Technical requirements
You need a device and software able to download, store and open standard PDF files: a current web browser, Adobe Acrobat Reader, Apple Preview, or another PDF reader or mobile app. The PDF has no copy protection (DRM). Please keep your own copy and reasonable backups. We are not responsible for problems caused only by unsupported or incorrectly configured third-party equipment or software, provided the PDF works and matches its description. This does not limit mandatory rights on compatibility and conformity.
13. Your licence
After payment we grant you a personal, non-exclusive, non-transferable licence for one person to download, store, read and print the Product for their own use, and to keep reasonable personal backups. If a Business Customer buys, the licence covers only the individual user who made the purchase. Team, classroom, enterprise and redistribution licences are not offered.
The licence gives you no ownership of the Product or of any intellectual property. We may end the licence only if the payment is refunded or reversed, or if you materially breach section 14.
14. What you may not do
You may not: resell, redistribute, sublicense, rent or lend the Product; share it with other people; upload or publish it on any website, social network, shared drive or file-sharing service; offer it as a free download; reproduce substantial parts of it for commercial use; remove copyright notices; present it as your own; create a competing product substantially derived from it; use it to train a commercial AI model or dataset; extract substantial parts by automated means; circumvent any technical protection; or use it unlawfully. Short quotations with attribution are allowed where copyright law permits.
15. Intellectual property
The Website and the Products (text, structure, layout, graphics, illustrations and branding, including the Assayhouse name and marks) are protected by copyright, trademark and database rights and belong to us or our licensors. Buying a Product gives you only the licence in section 13. Facts, regulatory texts and ingredient names remain public; the selection, compilation and presentation are protected. Third-party names and marks belong to their owners.
16. Updates and corrections
Your purchase is the edition available on the day of purchase. We intend to review Products about once a year, but a new edition, its timing and scope are not guaranteed, and future editions are not included unless the product page says so. A new edition may be sold as a separate Product or provided free at our discretion. New editions and revisions are announced on the Website, and each Product contains an update log listing every change since its first release. A new edition does not by itself mean an earlier edition was defective. If a material factual error is confirmed in the edition you bought, we supply the corrected file free of charge on request. Report errors to corrections@assayhouse.eu.
17. Refunds
Refunds are governed by our Refund Policy, which forms part of these Terms. We always put right a Product that is not delivered, is corrupted or incomplete, or materially differs from its description: first by fixing, replacing or re-delivering it, free of charge and within a reasonable time, and otherwise as the law provides. Stripe may also issue refunds under its own terms. Your statutory rights are unaffected.
18. Right of withdrawal
Who has it. If you are a Consumer in the EU, the EEA or the UK, you have the right to withdraw from the contract within 14 days of the day it was concluded, without giving any reason.
When it ends early. For a digital Product, the right ends once the download or access begins, if you gave the consent and acknowledgement described in section 10 before paying. Until then it applies in full.
How to withdraw. Use the withdrawal function on our Withdraw from contract here page, which is available at all times without an account. Alternatively, send a clear statement to info@assayhouse.eu or by post to Slnečnicová ulica 40, 949 01 Nitra, Slovak Republic, for example using the model withdrawal form on that page. Using the form is optional. You meet the deadline if you send your withdrawal before the 14-day period ends.
What happens next. We confirm receipt by email without undue delay, showing the content of your withdrawal and the date and time we received it. If the withdrawal is valid, we refund all payments received from you through Stripe, using the original payment method, at no cost to you, without undue delay and at the latest within 14 days of receiving your withdrawal.
Cancellation before payment is covered by our Cancellation Policy. You can leave checkout at any time before paying. Nothing in these Terms prevents a Consumer from exercising a right that cannot legally be excluded.
19. Conformity and legal guarantee
We supply each Product in line with its description at the time of purchase, in the advertised PDF format and language. Where consumer law applies, the Product must also meet the statutory conformity requirements. You have the rights provided by law if the Product is not in conformity. Under Slovak and EU law we are liable for a lack of conformity that becomes apparent within two years of supply. Normal differences in display, colour, zoom, printing or rendering caused by your device or settings are not a lack of conformity where the file itself works.
20. Complaints
Send complaints to info@assayhouse.eu (or by post to Slnečnicová ulica 40, 949 01 Nitra, Slovak Republic) with your name, order number, checkout email, the Product name, a description of the problem, the remedy you ask for, and any screenshots or device details. We confirm receipt of your complaint by email without undue delay and decide on it within 30 days of receiving it. Remedies are: bringing the Product into conformity (a corrected or replacement file), a price reduction, or termination and refund, as the law provides. Payment, receipt and tax questions may be referred to Stripe.
21. Chargebacks and payment disputes
Before starting a chargeback, please contact us or Stripe so we can verify the order, resend or replace the file, or otherwise put it right. You keep any lawful right to dispute an unauthorised or otherwise validly disputed transaction. If a transaction is refunded, reversed or successfully charged back, your licence to that Product ends unless the law requires otherwise; please stop using it and delete your copies.
22. Personal data
We process personal data as described in our Privacy Policy: to operate the Website, deliver Products, verify orders, provide support, handle withdrawals and complaints, prevent fraud, meet accounting and legal obligations, and protect legal claims. Stripe processes payment and tax data independently under its own privacy notice.
23. Cookies
The Website uses only technologies strictly necessary for its operation and security.
24. Third-party services and links
The Website relies on third parties such as Stripe, hosting, form-handling and email-delivery providers, and links to external reference sources. A link does not mean we control or endorse the linked content. Third-party services have their own terms. We are not responsible for an independent third party's website or service, except where the law makes us responsible.
25. Website availability and security
We take reasonable measures to operate and protect the Website but cannot guarantee uninterrupted availability (for example during maintenance, technical or hosting failures, outages, security incidents or force majeure). If the Website or the withdrawal page is unavailable, you can always withdraw or contact us by email at info@assayhouse.eu. You must not attempt unauthorised access, interfere with security, introduce malware, scrape or overload the Website, manipulate prices or checkout, impersonate others, or commit payment fraud.
26. No voluntary warranties
Beyond what these Terms and the product page state, and to the extent the law permits, we give no voluntary warranties: for example, that a Product will meet every individual expectation, suit an undisclosed purpose, that external links will stay available, that information stays current indefinitely, or that future editions will be issued. This does not affect the legal guarantee of conformity or any other mandatory consumer right.
27. Limitation of liability
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including for fraud, wilful misconduct, death or personal injury caused by negligence, or breach of mandatory consumer rights. Subject to that, we are not liable for indirect or consequential loss arising solely from use of a Product for an undisclosed purpose, failure to obtain professional advice, reliance on information after it became outdated, incompatible third-party equipment, unauthorised sharing or modification, or third-party services outside our reasonable control. For Business Customers only, and to the extent the law permits, our total liability relating to a Product is limited to the amount paid for it.
28. Indemnity (Business Customers only)
If you buy or use a Product exclusively for business purposes, you agree, to the extent the law permits, to compensate us for reasonable losses, claims and costs caused by your unlawful redistribution of the Product, infringement of intellectual property, material breach of the licence, or fraudulent or unlawful use of the Website.
29. International use
Availability of the Website in a country does not mean that every Product, payment method or currency is available there, or that the content is adapted to local law or translated. You are responsible for using the Product lawfully where you are. We or Stripe may restrict transactions in a country where sanctions, export controls, payment-provider rules, tax rules, fraud risk or other law require it.
30. Consumers' mandatory rights
Where you are a Consumer, the mandatory consumer-protection rules of the country where you habitually reside continue to apply, and nothing in these Terms reduces them.
31. Supervisory authority
Slovenská obchodná inšpekcia (Slovak Trade Inspection), Inspectorate for the Nitra Region, Staničná 9, P. O. BOX 49A, 950 50 Nitra 1, Odbor výkonu dohľadu, tel. +421 37 772 02 16.
32. Alternative dispute resolution (Consumers)
If you are a Consumer and believe we have infringed your rights, first ask us for a remedy at info@assayhouse.eu. If we reject your request or do not reply within 30 days of receiving it, you may submit a proposal for alternative dispute resolution to the ADR body. The proposal must be submitted within one year of our reply or of the end of the 30-day period. Proceedings before the Slovak Trade Inspection are free of charge.
Slovenská obchodná inšpekcia, ústredný inšpektorát, Odbor pre medzinárodné vzťahy a alternatívne riešenie spotrebiteľských sporov, Bajkalská 21/A, P. O. Box 29, 827 99 Bratislava 27, Slovak Republic · ars@soi.sk, adr@soi.sk · +421 2 58 27 21 23.
You may also contact another competent ADR body or the consumer authority in your country. ADR does not prevent either party from going to court.
33. Governing law
These Terms are governed by the laws of the Slovak Republic, excluding its conflict-of-law rules and, to the extent it could apply, the UN Convention on Contracts for the International Sale of Goods. If you are a Consumer, this choice does not deprive you of the mandatory protection of the law of the country where you habitually reside.
34. Jurisdiction
For Business Customers, the courts with jurisdiction for our registered office in the Slovak Republic have exclusive jurisdiction. Consumers may bring proceedings in the courts that mandatory consumer and procedural law allows, including in their home country.
35. Changes to these Terms
We may update these Terms, for example because of changes in law, in the Merchant of Record, in the Website or in the Products. The version shown when you bought applies to your purchase. A new version does not remove rights you already have. Each version shows its effective date, and earlier versions remain available on the Website.
36. Transfer
You may not transfer your licence without our written consent, except where the law allows. We may transfer our rights and obligations to a successor or acquirer of the business. A transfer does not reduce a Consumer's mandatory rights.
37. Severability
If a provision is invalid or unenforceable, it is limited to the minimum extent necessary and the rest continues to apply. For Consumers, an invalid provision is replaced by the applicable statutory rule.
38. No waiver
If we do not enforce a provision immediately, we do not waive the right to enforce it later.
39. Entire agreement
These Terms, the product page, the Refund Policy, the Cancellation Policy, the Privacy Policy and Stripe's buyer terms together form the agreement for your purchase. If a product page expressly grants a broader right than these Terms, the product page applies to that Product. Nothing here excludes an obligation that cannot lawfully be excluded.
40. Updates to the law
If a mandatory rule of law changes, the mandatory rule applies from its effective date even before these Terms are updated.
41. Language
The Website, these Terms, all other information and documents, and the Products are provided in English only. By continuing to payment you agree to receive all information and documents in English. If you do not agree, please do not complete a purchase and contact us at info@assayhouse.eu.
